Compulsory Acquisition of
Land

When
government or a local authority compulsorily acquires land, there is a
legislative right to compensation. In the case of a business it will be
necessary to examine the loss of profit, whether the business can be relocated
and at what cost, as well as the value of the business. We have given
specialist advice and training on this subject for more than 20 years.

Trade Practices Claims
- False and misleading representation by a supplier
of goods or services can result in the purchaser sustaining loss. The loss that
is compensable is generally not the same as that if a contract is breached and
it may be necessary to consider a wide variety of issues associated with putting
the claimant back in the position they would have been but for the
misrepresentation. We have produced expert reports in many hundreds of matters
and given evidence before the Federal Court as well as acting as court referred
arbitrators or mediators on the question of damages

Family Law
– understanding just what assets can be considered as appropriate to be shared.
This can include the value of a business, tax issues, superannuation, etc.
Detailed investigation is often required to trace assets that have been
“hidden”. We have considerable experience in the Family Law field, having
provided expert evidence in matters before the Family Court of Australia and
lectured extensively on family law accountancy issues. We hold membership
of the Australian Institute of Family Law Mediators and Arbitrators and have
been actively involved in mediating Family Law property settlements.

Contractual Loss

When a contract is broken one or more parties may suffer loss. Ensuring
that all potential and actual losses are identified is very important if proper
